PORTRAIT AGREEMENT

Please read these Terms of Service carefully. By clicking "I Agree", the purchaser agrees to the following terms and conditions and acknowledges that they have received, read, and understood the Photographer’s current pricing. 

PAYMENT SCHEDULE

A Session Fee of $200 is payable by direct deposit at the time of booking. This is deducted from the cost of your selected package with the balance being payable 3 days prior to your shoot. Failure to receive payment will result in your shoot being cancelled and all monies paid to date being forfeited.


CANCELLATION/RESCHEDULING POLICY

The Photographer must be given at least 48 hours notice should a Client need to reschedule their photo shoot. The Client is required to schedule an alternative date for their shoot on cancellation. The Client understands that in this eventuality there may be limited availability.


LATE ARRIVAL

The Client acknowledges that should they arrive late, their photo shoot time will be reduced. Depending on the makeup artist’s availability, their portrait session may need to be rescheduled.

GARMENTS

The Photographer cannot be held responsible for damage to Garments due to environmental events.

ELECTRONIC DEVICES

The Client may take photos once their makeover is complete however the Photographer asks that all electronic devices (mobile phones, cameras etc) are put away for the duration of the photo shoot.

EXPENSES

In the event that the Client selects a location outside of Brisbane, travel expenses such as parking, flights, accommodation and food will be reimbursed to the Photographer for all team members travelling. Flights and accommodation will be invoiced at the time of their booking with all other expenses invoiced to the Clients separately on arrival back at the studio after the assignment. Clients are responsible for all location fees and permits.

CREATIVE LICENSE

Images are edited at the Photographer’s discretion. The Photographer reserves the creative rights to edit and release only those images deemed creditable as professional in quality and within the photographer’s artistic standards. The Photographer will not release raw, unedited images to the client.

FAILURE TO PERFORM

The parties agree to cheerful cooperation and communication for the best possible result within the definition of the assignment. The photographer cannot be held responsible for schedule complications or lost photo opportunities due to the lateness of the clients or other principles.

FORCE MAJEURE

In the event that the Photographer or its assigns cannot perform the assignment due to weather conditions, illness, fire, casualty, Acts of God or other causes beyond the control of the parties, the Photographer will ensure the portrait session is rescheduled to the next available date at no monetary expense to the client.

The Photographer shall carry out the assignment with due and professional diligence. Elements beyond the Photographers control include faulty material, equipment failure, damaged memory cards, loss of memory cards/photos/negatives in transit between the Studio and professional laboratories employed by the Photographer, loss or damage to memory cards, negatives and proofs during processing and developing either by the Photographer, industrial disputes or civil disturbances which may inhibit or prevent the Photographer completing in whole or in part the assignment. In this case the Photographer shall not be liable for its complete performance of the assignment. It is agreed that the liability of the Photographer shall be limited to a refund of any monies paid under this agreement, which shall be in full & final satisfaction of any damage or loss suffered.

TURNAROUND TIMES

Retouched images taken at a portrait shoot will be presented to the Client in a password protected online gallery approximately 72 hours after their photo shoot. The Photographer may advise of any changes to this turnaround time at the photo shoot.

MONITOR CALIBRATION

The Client acknowledges that all images produced by the Photographer have been done so with the use of a colour calibrated monitor. Monitors used by the Photographer have been calibrated to meet printing standards, thus colour changes may occur when images are viewed on non-calibrated monitors. In order for printed images to meet the quality of the original digital files, they must be printed on high-quality photographic paper or on other professional photographic mediums, and done so by a professional lab. It is highly recommended that the Buyer orders printed images from a reputable, professional lab to ensure that the quality of his/her digital images is met.

COPYRIGHT

The Photographer retains the copyrights to all media created during the Clients photo shoot. The Client is given full print, use and share rights to their purchased images however they do not have the right to sell the images without permission.
